Terms and Conditions

Upon requesting/booking a babysitter or nanny, Babysitters on Demand users are required to agree to our Terms & Conditions which need to be completed/agreed and sent to us via email prior to their reservation. As for a regular placement/nanny, clients will be required to sign our Terms & Conditions before the start of the placement period.

1.0 Contract

1.1 The below Terms & Conditions are a legal binding agreement between you as the client and Babysitters on Demand as the agency.
1.2 Completion of the following – completion of a booking form and written confirmation via email to confirm babysitter/nanny/regular placement is instant acceptance of the agency Terms & Conditions.
1.3 The word “Client” refers to the person/family using Babysitters on Demand services.
1.4 The word “babysitter” or “nanny” refers to any person that Babysitters on Demand introduces to the client.
1.5 The “Terms & Conditions” are the terms of which Babysitters on Demand offers the client access to the services and use of the Babysitters on Demand agency. By booking a babysitter or nanny with us, the client agrees to abide by these Terms & Conditions. If the client does not agree to abide by these Terms & Conditions, then the client must refrain from using the Babysitters on Demand services.

 

2.0 Client Obligations

2.1 Any correspondence, communication either verbally, written or via email is confidential and the client agrees not to disclose to third parties.
2.2 All babysitting/nanny bookings must be made directly between you (the client) and Babysitters on Demand. (the agency).
2.3 No bookings are to be made directly with the babysitter/nanny. Should this obligation be ignored the babysitter/nanny is legally obliged to inform the agency and the relevant fees will be charged to the client.
2.4 The client agrees there is a 3-hour minimum for ALL bookings payable.
2.5 The client agrees NOT to pay the babysitter at the end of the booking/shift in cash. Our babysitters are paid on a fortnightly basis.
2.6 ALL fees (including sourcing and admin fee) must be paid upfront to Babysitters on Demand to ensure your job is locked in.
2.7 Payment must be made via direct deposit payment; the details will be provided upon sending you an invoice for payment.
2.8 The client agrees that Babysitters on Demand requires our babysitters and nannies to be in an occupationally safe and hygienic environment. For live in positions, the client must ensure it has adequate household insurance to protect the applicant’s possessions; and suitable live-in accommodation is provided to the applicant, including, without exception, a bedroom for exclusive use and access to a bathroom.
2.9 In the event Babysitters on demand (in its absolute discretion) believes that there is sufficient negative feedback or feedback is of a concerning nature regarding the client, then Babysitters on Demand will refrain from providing any babysitters or nannies.
2.10 The Client will notify the agency immediately of any extension of any temporary placement and agrees further fees will apply.
2.11 The Client agrees to notify the agency immediately if a babysitter has been introduced via a third party (agency, another website, advert etc.). Failing to inform the agency will result in full placement fees if the nanny has been employed by the client.
2.12 The client must not disclose and agrees to keep in confidence at all times the identity of all babysitters referred by Babysitters on Demand along with the contents of any documents/emails forwarded on the babysitter’s behalf. If the client discloses information about a babysitter to any third parties (i.e. friend, family member or colleague) who acting on that information, subsequently employs/engages any employed or referred babysitter, the client agrees to pay the applicable agency fee charged by Babysitters on Demand.
2.13 Babysitters are not permitted to make bookings exclusive of the agency. Bookings made exclusive of the agency would be in breach of their contract if they provide this information to you, resulting in termination of their contract.

3.0 Pricing

3.1 Payments are payable in Australian Dollars.
3.2 The fees (including sourcing and admin fee) must be paid upfront to Babysitters on Demand to ensure your job is locked in. Payment can currently only be made via direct deposit payment; the details will be provided upon sending you an invoice for payment.
3.3 Our fees and charges can be found on our website https://www.babysittersondemand.com.au/fees/ however; all jobs are individually quoted and provided to you immediately.
3.4 Bookings and care are confirmed when payment has been received by Babysitters on Demand.

4.0 Cancellation Policy

4.1 If cancellation of the babysitter is made within 8 hours of start time, a refund will be issued less 3 hours of the sitter’s time + the booking fee; more than 8 hours of start time, a refund will be issued less 2 hours of the sitter’s time + the booking fee; 24 hours notice, a full refund will be issued less booking fee.
4.2 If the employee cancels employment before start date the first option of Babysitters on Demand will be to find a suitable replacement. If your babysitter/nanny is sick or goes on holiday we will do our best to find a replacement/fill-in.
4.3 Babysitters on Demand reserves the rights to cancel immediately any babysitting or nanny services if a Babysitters on Demand carer has been mistreated, working in an unsafe environment, or is harmed in any way.

5.0 Guarantee

5.1 Although Babysitters on Demand endeavours to find a babysitter/nanny on request, we cannot always guarantee this will be possible. We endeavour to always provide the same nanny unless under circumstances such as illness, in which case we will do our best to provide a suitable replacement.

6.0 Liability

6.1 Babysitters on Demand endeavours to validate the background of our babysitters. Babysitters on Demand conducts thorough checks, conducts ongoing interviews, and ensures the nannies and babysitters hold or are in the process of obtaining current first aid, national police clearance, working with children checks and visas where applicable. Babysitters on Demand will inform the client as to the status of each of the above documents.
6.2 Babysitters on Demand will not accept liability for any loss, damage, or expense irrespective of how it may occur. The client indemnifies Babysitters on Demand against all actions, claims, losses, and damage.

7.0 Privacy and confidentiality

7.1 Babysitters on Demand do not sell or rent the client’s personal information or identification to third parties.
7.2 Babysitters on Demand will release information to third parties when we believe this is appropriate to comply with the law, police or fraud investigations, to protect the rights of Babysitters on Demand, our users or others.
7.3 Babysitters on Demand ensure that all personnel who have access to and/or process Personal Data are obliged to keep the personal data confidential and/or notify the client without undue delay on becoming aware of a personal data breach in accordance with the Australian Privacy Act 1988.

8.0 Warranties

8.1 We make no warranties or representations as to the quality, accuracy, or completeness of the content on the site or the information otherwise provided by any member.
8.2 While Babysitters on Demand uses reasonable endeavors to ensure that the site is available 24 hours a day, Babysitters on Demand does not make any representations or warranties that your access will be uninterrupted or error free. Access to the site may be suspended temporarily without notice in the case of system failure, web hosting errors, maintenance or repair or any reason beyond our control.

9.0 Disputes

9.1 Babysitters on Demand prefer to resolve any disputes via mediation.

10.0 COVID-19/ Illness

10.1 Babysitting is currently allowed in Western Australia; however, we ask that you maintain active in following the guidelines set out by the WHO. If you or your child experience any COVID-19 symptoms, have recently traveled interstate or overseas, or have been exposed to another person with any of the above, please contact us immediately to discuss further or cancel your booking.
10.2 The health and safety of our staff and our clients is extremely important to us. If at any stage our sitters notice a child is unwell, Babysitters on Demand will make direct contact with the client immediately and request you to return to the premises.
10.3 Babysitters on demand are unable to remove a child from the arranged premises without permission/consent from the client or emergency services in a case of emergency only.

11.0 Governing Law

11.1 The Terms & Conditions shall be governed in accordance with the laws of the state of Western Australia and users hereby submit to the non-exclusive jurisdiction of the Courts of that state.
11.2 Babysitters on demand website is owned and registered by Lia Ursich T/as Babysitters on Demand located in PERTH, WA.
